Transmission of the passengers’ data
Air carriers have the obligation to transfer passengers’ reservation data (PNR data) to the ANDV 48 hours before the flight’s scheduled departure (PNR48) and upon flight closure (PNR0). For flights to or from a territory outside the Schengen Area, this latter transmission must be accompanied by check-in data (API). Are excluded the data covered by the I, article 6 of the Law n° 78-17 of January 6, 1978 relating to information technology, files and freedoms.
This applies to all flights arriving or leaving the French territory, including the french overseas departments, regions, and communities, regardless of the nationality of the air carrier or the passengers.
Data transmission is carried out under the air carrier’s legal responsibility, even when their management is subcontracted.
Passengers’ information
Air carriers also have the obligation to inform travellers that their data are processed in the API-PNR system. They are required to include the following statement in the electronic media, interfaces, and forms used by their passengers (in all language versions of their supports) :
“In accordance with Article L 232-7 of the french Internal Security Code, please be informed that air carriers are required to transfer booking, checking, and boarding data collected from their passengers (PNR/API) to the French national public services and competent authorities, given the processing modalities and the purposes as defined in the Decree N° 2014-1095 of September 26, 2014,modified by the Decree N° 2018-714 of the August 3, 2018“.
The ANDV regularly verifies that airlines are complying with this obligation.
Pursuant to Article L232-5 of the Code of Internal Security, an air carrier may be subject to a fine of up to 50 000 euros for each journey, if it fails to comply with any of the obligations listed above.
Specific Points
Since October 1rst, 2026, the ANDV has also been collecting data on business aviation, subjected to the same rules and sanctions in the event of noncompliance.
As the Basel-Mulhouse Airport is located on the french territory, French law applies there, in accordance with Article 6 of the Franco-Swiss agreement governing its operation. Therefore, all booking data, and boarding data in the case of non-Schengen flights, must be transfered to France, regardless of the IATA code used (BSL or MLH).
